1. SCOPE
These are the terms and conditions on which we supply products to you in the United Kingdom and Worldwie (“Terms and Conditions”). Please read these Terms and Conditions carefully before you submit your order to us. We amend these Terms and Conditions from time to time. Every time you wish to use our site, please check these Terms and Conditions to ensure you understand the terms that apply at that time.
Before you may use or become a member of the Website, you must read and accept all of the Terms and Conditions and Privacy Policy. As you read this Agreement, you should also access and read the linked information. You are only authorised to use the Website if you agree to abide by all applicable laws and these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use the Website or any of VINCENT ART associated properties.
2. CONCLUSION OF CONTRACT
The display of products in the online shop does not constitute a legally binding offer; it is a non-binding online catalogue only. The products you have selected by pressing the “Add to basket” button are summarised again for you in an order overview at the end of the order process. Here you can review the various information provided during the order process and add to or correct it by clicking the “Change” button. By clicking the button “Buy now”, you send your order details and make a binding declaration to VINCENT ART that you want to purchase the products listed there. We automatically accept your offer upon receipt of your order. Directly after sending the order, you will receive an email with an order and contract conformation, in which the details of your order are listed again.
All Goods are offered for sale or rental subject to availability and subject to VINCENT ART acceptance of the Order.
VINCENT ART reserves the right to reject any Order without the obligation to assign any reason for so doing.
VINCENT ART has a policy to reserves the right to amend the specifications of any of the Goods without prior notice. Additionally, given the bespoke, hand crafted nature of many of the Goods sold on VINCENT ART, the exact size of Goods may alter slightly from piece to piece and from the official Goods dimensions listed on the VINCENT ART website.
VINCENT ART endeavours to display and describe as accurately as possible the printed colours of the Goods which appear on its website, but cannot undertake to give any assurance that the colours of Goods supplied will exactly match those displayed on the Buyer's monitor or home printing device.
3. PRICE, PAYMENT AND CURRENCIES
The price of the products is stated online and includes VAT. Shipping costs are not included in the price and will be charged in addition to the price in each case.
All prices are inclusive of any applicable sale taxes at the country of origin of the Goods. The Buyer shall be responsible for any other taxes (including but not limited to any custom duties) applicable in the territory to which the Goods are sent.
Payment must be made by credit card or debit card at the time of placing an Order which is accepted by the Seller. Payment in full will be taken at this time and the Contract will be in force. In case of a PayPal payment you will be automatically redirected to the payment services
PayPal after completing the order process. The process of payment is then governed by the terms of PayPal.
Vincent Art may offer multi-currency enabled transactions, which means the Buyer can select the currency of their choice when at check-out.
The Buyer undertakes that all details provided to the Vincent Art for the purpose of the Order and its delivery will be correct and that the chosen method of payment is the property of the Seller and that sufficient funds or credit facilities are available to cover the full cost of the Goods ordered. Vincent Art reserves the right to obtain validation of the Buyer's credit card or debit card details before accepting the Buyers Order.
Any credit towards payment is accumulated and may only be applied at the sole discretion of the Seller. Vincent Art reserves the right to limit, invalidate, or deny the application of credit to a purchase or rental at any time. Vincent Art may amend, invalidate, or terminate the conditions for accumulation of credits at any time in its sole discretion.
Any discounts or promotions are offered subject to availability and may be terminated or amended at any time by Vincent Art. The Seller reserves the right to reject any Order based on erroneous pricing, discounts, or promotions. Unless otherwise agreed by Vincent Art, any discounts or promotions are not cumulative, and no more than one discount or promotion shall be used on the same Order.
If you do not make any payment to us by the due date we may charge interest to you on the overdue amount of 3% a year above the base rate per annum published by the Bank of England and may charge companies 9% above the respective base rate per annum published by the Bank of England. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay us interest together with any overdue amount.
4. ORDERING AND DELIVERY
The Seller will endeavour to process and ship the purchase Order within days provided in PRODUCT INFO of Order Confirmation. Process time preparation depends of the type of product and is different for Original Paintings, Prints or Framed Prints. Any dates quoted for delivery of the Goods are indicative only. Time for delivery will not be of the essence of the Contract and the Seller will not be liable for any loss or expenses sustained by the Buyer arising from any delay in the delivery of the Goods howsoever caused.
The place for delivery of the Goods will be as shown on the Order and the normal method of delivery (unless specifically agreed otherwise) shall be regular postage or courier at the discretion of Vincent Art.
The Buyer must inspect the Goods on delivery and, in the case where Goods have been delivered by courier, sign the required proof of delivery document or collection acceptance document if required. A signature on that document will constitute conclusive evidence against the Buyer of receipt of the quantity of Goods indicated on that document free from any apparent defect or damage. If the Goods are alleged to be damaged or defective on delivery, a description of the alleged damage or defect must be given in writing at the time of delivery and signed by or on behalf of the Buyer.
If the Buyer wrongfully fails to take delivery of the Goods, the Seller shall be under no obligation to refund the Price.
5. SHIPPING CHARGES
We ship worldwide. Please note that shipments to countries outside of the United Kingdom may be subject to additional customs fees or import taxes. Please note that import tax is always added by the customs service when shipping to all EU countries and the obligation to pay it is the responsibility of the recipient of the shipment. The amount of import tax depends on the type of product and the destination country.
Customs not included The price does not include customs fees. Most countries have no import tax for original artworks, but you may have to pay the reduced VAT. Customs fees (if any) are to be calculated on arrival by the customs office and will be billed separately by the carrier.
6. RISK OF DAMAGE AND TRANSFER OF GOODS
Risk of damage to or loss of the Goods will pass to the Buyer on delivery at the agreed address.
Notwithstanding delivery and the passing of risk in the Goods, property in the Goods will not pass from the Seller until the Seller has received full payment of the Price and all other sums which are due, owing or payable by the Buyer to the Seller in respect of the Contract or any other Contract between the Seller and the Buyer.
7. RETURNS, REFUNDS, EXCHANGES AND CANCELLATIONS
The buyer shall have the right to return a purchase within fourteen days of Receipt for an exchange or refund at his/her preference if the item is Defective or for any other reason provided they do the following:
(I) Email vincent@vincentart.co.uk within fourteen days of Receipt stating: (a) Your Invoice Number (b) Artwork title (c) Reason for return and (d) Request for exchange or refund;
(II) Return the Goods to Vincent Art in the condition it arrived in, via the instructions that Vincent Art sends following your email;
(III) All Goods must be returned in their original packaging (which the Buyer should retain for the purpose) and must be in an unused condition.
In the event that the return is made without a reason such as damage to the product during transportation, the buyer is obliged to cover all return shipping costs. The import fee incurred by the seller will be deducted from the refund amount.
All framing supplied by Vincent Art is custom made to a specific purchase item. Any purchased item with a custom frame provided by Vincent Art shall not apply for any refund or exchange.
Vincent Art will not be held liable for any damage to any Goods caused anytime after Receipt of the Order. Vincent Art will not be able to accept any returns of Goods that have been damaged after Receipt.
Vincent Art will process and refund/exchange all returns within 30 days of receiving returned Goods from the Buyer in the post or via our chosen common carrier. For Goods shipped to a different country from the origin country for such Goods, Vincent Art may offer only a partial refund subject to shipping (both outbound and return) and handling costs.
Vincent Art do not accept cancellation of the orders.
8. INTELLECTUAL PROPERTY RIGHTS
The Content on the Website, excluding any Art Submissions, created by Vincent Art and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to Vincent Art, subject to copyright and other intellectual property rights under United Kingdom and foreign laws and international conventions. Content on the Website is provided to you as is for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcasted, displayed, sold, licensed, or otherwise exploited for any purpose whatsoever without the prior written consent of Vincent Art or as expressly provided herein. Vincent Art reserves all rights not expressly granted in and to the Website and the Content contained therein.
You agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein, including any use, copying, or distribution of third parties obtained through the Website for any commercial purposes. You agree not to circumvent, disable or otherwise interfere with security related features of the Website or features that prevent or restrict use or copying of any Content or enforce limitations on use of the Website or the Content therein.
9. NO GRANTING OF RIGHTS
By buying a photographic print, you are only acquiring material ownership of the print. No other rights are granted or implied. Any reproduction (copying), dissemination, leasing, public exhibition or other analogue or digital use is not permitted unless authorised by law. However, you can resell the print.
10. ABILITY TO ACCEPT TERMS & CONDITIONS
You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms and Conditions, and to abide by and comply with these Terms and Conditions. The Website is not intended for children under 13. If you are under 13 years of age, then please do not use the Website.
11. ASSIGNMENT
These Terms and Conditions, and any rights and licenses granted hereunder, may not be assigned, transferred, delegated, and sublicensed by you, but may be assigned, transferred, delegated, and sublicensed by Vincent Art without restriction.
12. COPYRIGHT NOTICE
The Website is All Rights Reserved and no portion of the Website may be copied, reproduced, transmitted, derived, or otherwise used for any purpose without the prior written permission of Vincent Art.
13. COLLECTING, PROCESSING AND USING PERSONAL DATA
All provisions regarding the protection of your data can be found at the VINCENT ART privacy policy.
14. APPLICABLE LAW
These Terms and Conditions are governed by English law and you can bring legal proceedings in respect of the goods in the English courts.
